In 2020 the need to run your errands via digital ways without personal contact arose out of necessity. Back then and also now there is the option to buy real estate without personal contact. Although the proceedings are not paper-free because the land registry welcomes submissions with a few exceptions only on paper but your personal appearance can be avoided in the course of preparing and signing your agreement. The future will bring the digitalization of the land registry, the system and the adherent laws are being developed. Until then the following digitalized processes allow you to conclude your agreement without the need of your personal appearance.
If you have experience about concluding an agreement in front of a lawyer, you may know that your identification is the first step (when you showed your ID to the lawyer who made a photocopy of your cards). The digital equivalent of this comparatively simple momentum is way more complicated. Since digital contents can be modified posteriorly with certain software, the legal certainty requires the rules of online identification to exclude posterior modifications.
There are several solutions for online identification so the Bar audited all software to determine which ones are appropriately safe. The process of online identification is the following, which I record with the audited software (mainly Skype):
1. You have to position your camera at the beginning of the call to make your face visible enough and you have to declare that you give your consent to for you to be identified online.
2. You have to show all sides of your ID and other cards visibly to the camera and you have to read your data out loud.
3. You have to declare whether you or your close relative or a person close to your close relative in in contact with a person who is exposed to the media.
After online identification your agreement should be signed.
By the time we arrive to point to identify you online, at best we finalized your agreement’s conditions and you received the finalized copies via e-mail or post. If you have the finalized documents and we finished your online identification, you can sign your agreement complying with the following:
1. We talk through the content of the documents to be signed once more, especially the terms of payment and the bank account numbers.
2. I will ask you to position the camera to make your face, your hand that you are signing with and the document clearly visible at the same time.
3. You can start signing the documents.
4. After you finished signing all the necessary copies you have to show the documents to the camera and you have to declare that you acknowledge the signatures on those documents as your own signature.
After signing you have to forward the documents to the next signer or to me if everyone signed them. When I receive the documents I countersign them and land registry process starts regarding which you will not have to run further errands.
